Does Evasion granted by the AoF count for being over DEX for the 60% Penalty?
I currently have Evasion and Dexterity trained equally, with any DEX boosting gear I have boosting them both, equally.
But if I equip an AoF, my Evasion gains ~30K over my Dexterity.
Is this 30k subject to the 60% penalty? And therefore do I have to train my DEX higher to take into account the boost from an AoF?

Yes,
The AoF works on skills like any dex equipment. The dex is compared to the actual level of your evasion after items are equipped.
As an aside, I really disagree with the dex having to be equal to evasion for full effect.
Yes, the excess will get the 40% penalty.

I also believe that when you go against those few characters that use EC, that lowers your dex and mismatches your dex/evasion to get the penalty.
